An image is copyrighted the moment it is created. All of my art is copyrighted and is not to be used without my permission. My images are not in the public domain and all images, unless otherwise noted, are © April VanSickle. I retain all intellectual property rights to my artwork, even if you buy a print or the original, unless you have a signed legal contract from me where I have signed over certain rights to you. A note on copyright watermarks

The Digital Millennium copyright act (DMCA) of 1998 makes it unlawful for anyone to remove or tamper with technological measures used by copyright owners to protect their work. I.e. you cannot remove the watermark or copyright text as it is against the law.

Image Usage Policy

The art on this site cannot be modified, redistributed or reproduced in any way with exception being the terms of use I grant you on this page as long as you follow all the stated conditions for use. I reserve the rights to modify the terms at any time. By using my art, you agree to these terms and any future changes.

Please notify April if you see her work being used improperly and outside the limitations of these Image use policies. Please do not contact the individual or company yourself. Some cases may be legitimate licensed uses, but we will investigate each report and take action as is appropriate. Thank you for your help!

No Commercial Use of Artwork without permission

You are not permitted to use April's art in any manner for any sort of for-profit or not-for-profit company without a valid licensing contract. Unless otherwise stated, a non-for-profit company is considered to be a commercial venture and must follow the same rules as a for-profit company. You may not create derivative works of my art for sale on products without a valid licensing contract. You may not redistribute, reproduce or use my art for the manufacture of products without a valid licensing contract. You may not use April's art as your business logo, letterhead, business card etc. without a valid licensing contract.

Companies wishing to use April's art for any sort of commercial endeavor, including a business logo, should contact April with your inquiry and the nature of your business so that April can review the proposal and decide if it is something she would like to be a part of. Please note there are usage fees for limited use of April's art in certain circumstances (i.e. logos).

Not-for-profit and Charity Organizations

Not-for-profit and charities are considered commercial for-profit companies and should follow the policies for commercial on this page if not otherwise stated. If you would like to purchase or use April's art, then please do contact April and discuss your situation with her as permissions may vary. You may be granted permission to purchase a limited quantity of items at a discounted price or a discounted usage fee depending upon what you are asking for.

Displaying Art on Personal Websites

Yes, you may display April's artwork on a personal non-commercial website as long as the following conditions are met.

• An image may only be removed and displayed in a personal, non-commercial family friendly website if it remains unaltered in any way, including all watermarks and text.
• You must provide a clickable link back to April's website on each and every page that the art is displayed.
• Please save the image to your hard drive and upload to your web host's server and do not hotlink to April's images.

Displaying Art on Commercial Websites

Authorized resellers of April's art are allowed to remove and use the product images and text from this site to display on their own website for the purpose of showing the item for sale only. They may not use April's art as part of the website graphics or business logo without a valid licensing agreement. Authorized resellers do NOT need to provide a link back to April's website from their own website. Please save the image to your hard drive and upload to your web host's server and do not hotlink to April's images.

I would like to feature your art in our ezine, may we do so?

I am flattered, thank you. :) Please contact me to let me know and to also get my consent. Usually though, I can't imagine saying anything other than yes. However, there might be an issue with the piece(s) you are wanting to showcase, so it is always best to ask first. Plus I can help promote your ezine as well if I know about it.

Can I use your art for Tubes/Siggies/Collages/Stationery/Web designs etc

No. Unfortunately it is too time consuming for me to police and answer emails. I do not allow this sort of use of my art at this time. I may in the future if I find a licensing arrangement, so check back if you are interested.

Can I use your art for desktop Wallpaper? Make wallpapers for others to download?

Individuals can save the image to their hard drive and use it as a desktop wallpaper on their personal computer if they like. However, you may not use my art to create desktop wallpapers for others to download off of your website, or as part of a collection on CD or any other way of redistribution.

Can I get a tattoo of your art?

Yes for individuals as long as the following conditions are met. I am very flattered you enjoy my work enough to tattoo it on your body! Individuals are granted permission to get tattoos of any of April's art as long as you inform the tattoo artist that they are required to destroy the stencil they created when finished as they are not allowed to resell the design without a licensing contract with me. No digital files will be provided. I do not have tattoo flash available for sale at this time. If I do in the future, I will update this with the information on where to buy it.

Tattoo artists are not allowed to offer any of April's work as a design without a valid licensing contract.
